Service Regulation Pursuant to the Executive Reorganization Act of 

1971 



Under the Executive Reorganization Act of 19 71 (Laws of 
Montana, 1971, Chapter 272) , the Governor is authorized to sign 
executive orders implementing the various chapters of the Act. 

THEREFORE, I, FORREST H. ANDERSON, Governor of the State 
of Montana, pursuant to the authority invested in me, order that: 

1. Chapter 17 (Sections 82A-1701 through 82A-1703) of 
the Executive Reorganization Act of 1971 providing for the creation 
of the Department of Public Service Regulation shall be effective 
September 9, 1971. 

2. From and after September 9, 1971, the Department and 
its functions shall be organized, supervised, administered, and 
executed pursuant to the Executive Reorganization Act of 1971, the 
Constitution, other statutes of the state, and the reorganization 
plan (dated August 30, 1971) prepared and submitted by the Board of 
Railroad Commissioners ex-officio Public Service Commission. 

3. This executive order shall not affect the validity 

of any judicial or administrative proceeding pending or which could 
have been commenced before the date of the order, and the depart- 
ment or unit which succeeds to the functions of an agency trans- 
ferred or retained by this order shall be substituted as a party in 
interest. 

4. The Department's organization charts and descriptions 
of major programs are appended to this order. However, the Secretary 
of State need not send the charts and descriptions of major programs 
to those persons named in Section 6 of the Executive Reorganization 
Act as a part of this order.

MAJOR PROGRAI-IS 
Centr a lized Services 

Description : 

This program will be charged with the responsibility for most of the 
clerical and administrative duties of the Department. The internal ac- 
counting, record keeping, payroll, purchasing, billing, and revenue col- 
lecting duties of the Department will be included in this program. In 
addition, this program will include utility auditing. 
Authority : 

Authority for the program is found throughout: 

(1) Title 8, Chapter 1 -- Water Carriers 
Title 8, Chapter 2 — Pipeline Carriers 

(2) Title 24, Chapter 1 -- Electric Lines 

(3) Title 70, Chapter 1 -~ Utilities 
Title 70, Chapter 4 -- Television 

(4) Title 72 
Division Responsible : 

The Centralized Services Division will be responsible for this program.

Description : 

This program will include all of the functions of the Department 
which relate to the public utilities which the Public Service Commis- 
sion regulates, except utility auditing and legal services. Rate 
determinations for common carriers (pipelines), natural gas utilities, 
electric utilities, water utilities, and telephone and telegraph 
utilities will be included in this program. In addition, the standards 
and safety functions of the Department relating to these utilities will 
be administered as a part of this program. 
Authority : 

IkfSt of the authority for this program is found in Title 70, 
Chapter 1, R.C.M. 1947, which deals with public utilities. Authority 
is also found in Title 8, Chapter 2 (Common Carriers) and Title 24, 
Chapter 1 (Electric Lines). 
Division Responsible : 

The Utility Division of the Department will be responsible for 
this program.

Transportation 

Description : 

The functions of the Department relating to transportation regula- 
tion will be included in this program. This program will determine 
rates and time schedules for motor carriers and railroads, and will 
administer the safety functions of the Department relating to these two 
modes of transportation. In addition, this program will carry out 
enforcement functions relating to motor carriers under the Motor Carrier 
Act. 
Authority : 

Authority for this program is found in Title 8, Chapter 1 (Motor Carriers) 
and Title 72 (Railroads). 
Division Responsible : 

The Tx.;. asportation Division of the Department will be responsible 
for thifr program.

Legal Services 

Description : 

This program V7ill include the legal services which the Department 
performs. Hearings, court cases, appeals, and Commission orders will 
be handled as a part of this program. This program will also administer 
the insurance and authority functions relating to motor carriers, since 
these functions primarily involve legal determinations and expertise. 
Authority : 

Legal services are a^ necessary part in the performance of all the 
Department's functions. Consequently, authority for this program cannot_^ 
be specifically pinpointed but is found throughout the citations 
enumerated tmder the Centralized Services program. 
Division Responsible : 

The Legal Division of the Department will be responsible for this 
program.
